NSW Fire Safety Fines 2026 | The New Liability for Directors

The $66,000 Risk | Why NSW Business Owners Are Running Out of Time for the 2026 Fire Safety Mandate

The “Best Practice” Era is Over

For the last decade, many NSW building owners have treated Australian Standard AS 1851-2012 as a “recommendation“—a gold standard to aspire to, but not always a strict legal requirement. Maintenance schedules have been ad-hoc, often sticking to the bare minimum to get an Annual Fire Safety Statement (AFSS) signed.

That era ends on February 13, 2026.

The NSW Government’s deferral of the mandatory adoption of AS 1851-2012 is not a reprieve; it is a final warning. Come February 2026, the “best practice” framework becomes black-letter law. For business owners and company directors, the shift involves more than just scheduling a few extra inspections. It represents a fundamental change in liability, insurance coverage, and operational risk.

If your building is still operating on an “annual check-up” mentality, you are already behind. This article outlines the specific financial and legal risks you face and why waiting until late 2025 to adapt is a strategy for disaster.

The “Hard Stop” | What Actually Changes in 2026?

To understand the risk, you must understand the change. Currently, many older buildings in NSW maintain their fire systems based on “manufacturer’s specifications” or older standards (like AS 1851-2005). These regimes often allow for less frequent testing and less rigorous record-keeping.

From February 13, 2026, the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation mandates that all routine service must comply strictly with AS 1851-2012.

What does this look like in practice?

  • Frequency – It is no longer acceptable to check a sprinkler pump once a year. It must be run and tested monthly.

  • Scope – It is no longer acceptable to just “look” at an exit sign. A 90-minute discharge test is mandatory every 6 months.

  • Evidence – It is no longer acceptable to have a paper tag signed. You need rigorous “Baseline Data” to prove the system performs as it was originally designed.

The Financial Sting | Fines and Penalties

The NSW Building Commissioner has been clear: the leniency period is over. The new regulations come with teeth.

1. Corporate Fines up to $66,000 Under the new legislative framework, failure to maintain essential fire safety measures (EFSMs) in accordance with the mandated standard is a strict liability offence. For corporations, on-the-spot fines and court-imposed penalties can reach $66,000 per breach.

  • Scenario: A fire inspector visits your site in March 2026. They ask for evidence of your February “Monthly Sprinkler Test.” You don’t have it because you’re still on an annual schedule. That is a breach.

2. The Insurance Loophole. This is the “silent killer” of businesses. Commercial property insurance policies almost universally contain a clause requiring the policyholder to comply with all “statutory obligations.” If a fire occurs in May 2026 and a forensic investigation reveals your maintenance program was not compliant with the new AS 1851-2012 mandate, your insurer may have valid grounds to deny your claim. You could be left covering millions in damages, business interruption costs, and tenant lawsuits out of your own pocket.

The “Accredited Practitioner” Bottleneck

A critical component of the 2026 changes is the tightening of who can sign off on your safety measures. The “competent person” of the past is being replaced by the Accredited Practitioner (Fire Safety) – APFS.

Starting in 2026, only practitioners accredited under the Fire Protection Accreditation Scheme (FPAS) will be able to endorse specific measures on your AFSS.

  • The Problem – There is currently a shortage of accredited practitioners in NSW.

  • The Risk – If you wait until January 2026 to find a provider, you may find that no accredited practitioners are available to audit your building. Without an accredited signature, you cannot submit your AFSS. Without an AFSS, your building is illegal to occupy.

The “Baseline Data” Trap

This is the most technical, yet most dangerous, aspect for business owners. AS 1851-2012 requires that test results be compared against “Baseline Data”—the original design pressure, flow rates, and sound levels from when the building was built.

  • The Reality: Most buildings built before 2010 have lost this data.

  • The Consequence: A technician strictly following AS 1851-2012 in 2026 cannot pass your system without this data. They will be forced to issue a “Non-Conformance” or even a “Critical Defect” notice.

  • The Fix – You need to commission a “Baseline Data Re-establishment” audit now, before the deadline hits.

Your Action Plan | The Next 12 Months

As a business owner, you do not need to know how to service a pump, but you do need to manage the asset. Here is your roadmap to avoiding the 2026 cliff:

  1. Q2 2025 – The Audit: Commission a gap analysis. Ask your current provider: “Do we have Baseline Data for all our systems?” and “Is our current schedule AS 1851-2012 compliant?”

  2. Q3 2025 – The Upgrade: If you are missing data or have lingering defects, fix them now. Budget for “Baseline Data Re-establishment.”

  3. Q4 2025 – The Contract: Ensure your maintenance contract for 2026 explicitly states compliance with AS 1851-2012 and includes monthly testing.

  4. Q1 2026 – The Transition: Your first monthly test should happen in January 2026, ensuring you hit the February 13 deadline running.

Liability is Optional

The legislative changes in 2026 are mandatory, but the liability is optional. If you act now, the transition is merely an administrative update. If you wait, it becomes a crisis of compliance, insurance, and legality.

Don’t risk your business on a “she’ll be right” attitude.
